Statement of Use

Home | Flat Fee Filings | Statement of Use

When you file your applications on an Intent-to-Use basis, the U.S. Patent and Trademark Office (“USPTO”) will not issue a registration until you prove that your mark is in actual use by filing an SOU. Within six (6) months of the USPTO approving an Intent-to-Use application and issuing a Notice of Allowance, you must either file an SOU or request an additional six-month extension.

The USPTO charges a $100 filing fee per class of goods/services covered in the SOU, but we will explain all of that during your free consultation.
