Request for Extension of Time to File Statement of Use
When you file your application on an intent-to-use basis, the U.S. Patent and Trademark Office (USPTO) will not issue you a registration until you prove that your mark is in actual use in commerce through the filing of a Statement of Use. Within six (6) months of the USPTO approving an Intent-to-Use application and issuing a Notice of Allowance, you must either file an SOU or request an additional six month extension. You may request up to five (5) six-month extensions of time – i.e., a total of 36 months.
The USPTO charges a $125 filing fee per class of goods/services, but we will explain all of that during your free consultation.
